
A lawsuit has been filed challenging the Voorhees Planning Board’s denial of a proposed Super Wawa. As a result, the decision is now being reviewed in state Superior Court.
The complaint was submitted by developer NIKI-J&J Voorhees Cooper Partners LLC. According to the filing, the board’s decision included procedural issues and overlooked key evidence.
In December, the Planning Board voted against the proposal. The project was planned along Route 73 near the Cooper Road intersection. Concerns about increased traffic were cited as the primary reason for denial.
However, the developer argues those concerns were not supported by evidence. Instead, the board is said to have relied on unsupported assumptions regarding traffic impacts.
The lawsuit requests that the court reverse the denial. In addition, approval of the project without further hearings has been sought. Alternatively, the case could be sent back with instructions to approve the application.
The proposed Wawa would span the border of Voorhees and Berlin Township. As a result, the site is positioned to serve multiple communities.
Ultimately, the case will determine whether the Planning Board’s decision can stand or must be overturned.
